What applies in cases of defect, wrong delivery and return
Returns and warranty
We supply businesses. There is therefore no statutory right of withdrawal — under section 312g BGB it is available to consumers only. What applies instead is set out here.
No right of withdrawal on sales to businesses
The fourteen-day right of withdrawal exists under German law for consumers buying at a distance. It does not apply to a sale to a business. You therefore cannot return an order without reason.
That takes nothing away from your rights where a delivery is defective or wrong. Those are set out below.
Defective or wrong delivery
Please examine the goods without delay upon receipt. Notify us of apparent defects and wrong deliveries without delay, and of hidden defects without delay after discovery (section 377 HGB). Without such notice the delivery is deemed approved.
We will remedy the defect or supply goods free of defects — the choice is ours. Only if that fails may you reduce the price or withdraw from the contract.
- Period for claims for defects: twelve months from delivery
- For used goods, claims for defects are excluded; the condition is stated in the description
- Unaffected: fraudulent concealment, guarantees, personal injury, gross fault and claims under the German Product Liability Act
Transport damage
Where packaging is visibly damaged, have the carrier record this on the consignment note before you confirm receipt. Confirming receipt without reservation may exclude claims against the carrier — and with them our own ability to pursue the loss there.
Photograph the packaging and the goods before unpacking and send us the images with the damage report.
Returns by prior arrangement
Please do not send anything back unrequested. Report the case first; we will agree the route and give you the address. We cannot allocate an unannounced return.
Where the defect is attributable to us, we bear the cost of return. Otherwise the customer bears it.
Custom-made items and freight goods
Goods manufactured or procured to customer specification are not accepted back where they are free of defects. For freight goods — machines and plant not shipped as parcels — collection, loading and scheduling are agreed separately; costs follow the actual effort involved.
